§ 1 Conclusion of the travel contract
(1) By registering, the customer makes a binding offer to the tour operator edeltravel Luxusreisen to conclude a travel contract.
(2) Registration can be made in writing, verbally, or electronically. The registering customer is liable for the obligations of all other travelers listed in the registration under the travel contract, provided that he has assumed such an obligation by means of an express and separate declaration.
(3) Ein Reisevertrag kommt mit der Annahme durch den Reiseveranstalter edeltravel Luxusreisen zustande. Die Annahme durch edeltravel Luxusreisen bedarf keiner besonderen Form. Bei oder zeitnah nach Vertragsschluss wird edeltravel Luxusreisen dem Kunden eine schriftliche Reisebestätigung mit dem Reisepreissicherungsschein übersenden.
(4) If the content of the travel confirmation deviates significantly from the content of the registration, this constitutes a new offer from edeltravel Luxusreisen, to which edeltravel Luxusreisen is bound for a period of 10 days. The travel contract is then concluded on the basis of this new offer if the customer declares acceptance within this period. The customer may declare acceptance expressly or by conclusive declaration, e.g., by making a down payment, paying the balance, or commencing the trip.
§ 2 Definitions
(1) Consumers within the meaning of these terms and conditions are natural persons who enter into a business relationship with edeltravel Luxury Travel without this being attributable to their commercial or self-employed professional activity.
(2) Entrepreneurs within the meaning of these terms and conditions are natural and legal persons or partnerships with legal capacity who enter into a business relationship with the agency in the exercise of their commercial or independent professional activity.
(3) The organizer within the meaning of these terms and conditions is edeltravel Luxusreisen.
§ 3 Payment
(1) A deposit of 20% of the total travel costs is due immediately upon receipt of the travel confirmation/invoice. The deposit must be paid into the edeltravel Luxusreisen business account specified below and will be credited towards the total trip price. Flight services are arranged exclusively by edeltravel Luxusreisen. Upon completion of the booking, 100% of the flight price is always due with the deposit for the trip price.
(2) Die Restzahlung auf den Reisepreis ist, soweit nichts anderes im Einzelfall (Sonderkonditionen) vereinbart wurde, 35 Tage vor Reiseantritt fällig und zu leisten, wenn feststeht, dass die Reise durchgeführt wird. Die Restzahlung muss unaufgefordert bei edeltravel Luxusreisen eingegangen sein. Maßgeblich für die Rechtzeitigkeit der Zahlung ist deren Gutschrift auf dem Konto beim Reiseveranstalter.
(3) In the case of short-term registrations less than two weeks before the start of the trip, the total trip price is due immediately upon receipt of the security certificate and must be paid to the tour operator.
(4) Failure to make the down payment and/or the remaining payment shall have no effect on the validity of the travel contract. Insofar as edeltravel Luxury Travel is willing and able to provide the service, there shall be no entitlement to the travel service without full payment of the travel price. This shall not apply to the customer's statutory or contractual rights of retention.
(5) If the travel price has not been paid despite being due and a deadline set by edeltravel Luxusreisen, edeltravel Luxusreisen may refuse to carry out the trip and charge the customer cancellation fees in accordance with clause 4.
(6) Payment can be made by bank transfer or valid credit card (MasterCard, Visa, American Express). For credit card payments, a discount fee of 1.2% will be charged on the amount to be booked. In individual cases, these costs may vary depending on the credit institution.
(7) Should service providers or service partners of edeltravel Luxusreisen GmbH adjust their payment terms/payment targets due to individual circumstances, the company reserves the right to pass on these adjustments to the payment targets in full or in part.
§ 4 Services
(1) Welche Leistungen vertraglich vereinbart sind, ergibt sich aus den Leistungsbeschreibungen im individuellen Angebot und/oder aus dem Internetportal von edeltravel Luxusreisen und den hierauf bezugnehmenden Angaben in der Reisebestätigung.
(2) edeltravel Luxury Travel expressly reserves the right to declare a change to the information in the brochure for objectively justified, significant, and unforeseeable reasons prior to conclusion of the contract, of which the customer will be informed prior to commencement of the trip.
(3) If an individual itinerary is put together at the customer's request, the obligation to provide services shall be based exclusively on the specific offer made to the customer and the respective confirmation of registration.
§ 5 Cancellation by customers before the start of the trip / Cancellation fees / Rebookings / Replacement persons*
(1) The customer may withdraw from the contract at any time prior to the commencement of services. The declaration of withdrawal must be made to edeltravel Luxusreisen or, if the service was booked through a sales agent, the declaration of withdrawal may also be made to the sales agent. It is recommended that the declaration of withdrawal be made/stored on a permanent data carrier.
Edeltravel Luxusreisen loses its claim to the agreed travel price if the customer withdraws before the start of the service or does not commence the package tour or the booked individual service. Edeltravel Luxusreisen may instead demand reasonable compensation. This only applies if Edeltravel Luxusreisen is not responsible for the withdrawal and if no exceptional circumstances arise at the destination or in its immediate vicinity which significantly impair the performance of the booked service or – if included in the booked service – the transport of persons to the destination. For the purposes of this clause, circumstances are unavoidable and extraordinary if they are beyond the control of Edeltravel Luxusreisen and their consequences could not have been avoided even if all reasonable precautions had been taken by Edeltravel Luxusreisen.
The cancellation fees are listed below as flat rates and are determined based on the travel price minus the value of the expenses saved by Edeltravel Luxury Travel and minus any income Edeltravel Luxury Travel earns by using the services elsewhere. In addition, the following flat rates take into account the period between the cancellation notice and the start of the service. The flat rates must be justified by Edeltravel Luxusreisen at the customer's request. The customer is always free to prove that Edeltravel Luxusreisen has not incurred any damage as a result of their cancellation or that the fees to which Edeltravel Luxusreisen is entitled are significantly lower than the flat-rate compensation demanded by Edeltravel Luxusreisen.
The following flat-rate cancellation fees are also payable if a travel participant does not arrive at the respective departure airport or place of departure or service at the times stated in the booking documents, or if the service cannot be provided due to the absence of travel documents, such as a passport or necessary visas, for which Edeltravel Luxusreisen is not responsible. passport or necessary visas, cannot be provided.
Edeltravel Luxury Travel reserves the right to demand higher, individually calculated compensation instead of the flat-rate cancellation fees listed below, provided that Edeltravel Luxury Travel can prove that it has incurred significantly higher expenses than the applicable flat-rate cancellation fee. In this case, Edeltravel Luxusreisen is obliged to specify and substantiate the compensation demanded, taking into account the expenses saved and any other use of the travel services.
If Edeltravel Luxury Travel is obliged to refund part or all of the agreed travel price as a result of a cancellation, Edeltravel Luxury Travel must do so immediately, and in any case within 14 days of receiving the cancellation notice.
(2) The flat-rate cancellation fees per person are calculated as a percentage of the travel price in the event of cancellation.
- Up to 31 days before the start of the trip/service = 20% of the agreed price
- From the 30th day to the 21st day before the start of the trip/service = 30% of the agreed price
- From the 20th day to the 11th day before the start of the trip/service = 70% of the agreed price
- From the 10th day until the day of departure or, in the event of non-departure or non-use of services, 80% of the agreed price.
- From the 5th day until the day of departure or, in the event of non-departure or non-use of services, 100% of the agreed price.
Pure flight performance:
Rebookings and cancellations of flight services only are expressly subject to the terms and conditions of the respective airline. The tour operator edeltravel Luxusreisen acts expressly as an agent for the respective service. For private flight services (private flights), the terms and conditions of the respective provider also apply.
(3) There is no legal entitlement to changes regarding the travel date, destination, accommodation, or type of catering (rebooking). If rebookings are made at the customer's request after conclusion of the contract (rebooking), edeltravel Luxusreisen will charge a rebooking fee of EUR 150.00 per change up to 30 days before the start of the trip. Rebooking requests made after this deadline can only be carried out, if at all possible, after withdrawal from the travel contract under the above conditions and simultaneous re-registration. This does not apply to rebooking requests that incur only minor costs.
(4) The customer's right to provide a replacement participant within a reasonable period of time before the start of the service by means of a declaration on a durable medium remains unaffected by the above conditions. Such a declaration shall in any case be deemed to have been made in good time if it is received by Edeltravel Luxusreisen no later than seven days before the start of the service. If the customer is unable to commence the trip, it is possible to provide a replacement person up to the start of the trip who will assume the rights and obligations arising from the travel contract in their place. The customer must notify the tour operator of the replacement person in advance. The tour operator reserves the right to reject this person if they do not meet the special requirements of the trip, if their inclusion is not possible for organizational reasons, or if their participation is contrary to legal regulations or official orders. The replacement person entering into the contract and the original customer are liable to the tour operator for the travel price and as joint and several debtors for all additional costs incurred by the replacement person, such as the rebooking of airline tickets.
§ 6 Insurance
edeltravel Luxury Travel recommends taking out travel cancellation insurance and international health insurance. You can obtain travel insurance quotes from edeltravel Luxury Travel.
§ 7 Reimbursement for unused services
If the customer does not make use of individual travel services as a result of early return or for other compelling reasons, the tour operator will endeavor to reimburse the saved expenses. This obligation does not apply if the service is insignificant or if legal or official regulations prevent reimbursement.
§ 8 Withdrawal and termination by the tour operator
edeltravel Luxury Travel may withdraw from the travel contract before the start of the trip or terminate the travel contract after the start of the trip in the following cases:
1. Without notice:
If the customer persistently disrupts the trip despite a warning from the tour operator, or if they behave in such a way that is contrary to the contract that immediate termination of the contract is justified. In such cases, the local representatives of edeltravel Luxusreisen are authorized to exercise the rights of edeltravel Luxusreisen. If edeltravel Luxusreisen terminates the contract, it retains the right to the travel price; however, it must offset the value of the expenses saved, which it obtains from other use of the unused services, including the amounts credited to it by service providers.
2. Up to two weeks before departure:
If the advertised or officially stipulated minimum number of participants is not reached, edeltravel Luxusreisen may withdraw from the travel contract if a minimum number of participants is specified in the travel advertisement for the trip in question. If, after exhausting all possibilities, it becomes unreasonable for edeltravel Luxusreisen to carry out the trip because the number of bookings for this trip is so low that, if the trip were to go ahead, the costs incurred would exceed the economic sacrifice limit for this trip, the customer will be refunded the trip price paid immediately. The customer must be notified immediately after the conditions have been met and the travel price must be refunded immediately.
3. Up to 4 weeks before departure:
If, after exhausting all possibilities, it is unreasonable for edeltravel Luxusreisen to carry out the trip because the number of bookings for this trip is so low that carrying out the trip would mean exceeding the economic sacrifice limit for the tour operator, the tour operator may withdraw from the contract. However, a right of withdrawal at this point in time only exists if edeltravel Luxusreisen is not responsible for the circumstances leading to it (e.g., no calculation errors) and if it can prove the circumstances leading to its withdrawal and has made the customer a comparable alternative offer. If the trip is canceled for this reason, the customer will be refunded the trip price paid without delay. In addition, the customer will be reimbursed for their booking expenses if they do not take advantage of a replacement offer from the tour operator.
§ 9 Termination of the contract due to exceptional circumstances
If the trip is significantly impeded, endangered, or impaired as a result of force majeure that was not foreseeable at the time the contract was concluded, both the tour operator and the customer may terminate the travel contract. If the contract is terminated, the tour operator may demand reasonable compensation for the travel services already provided or still to be provided in order to terminate the trip.
The tour operator is obliged to take the necessary measures, in particular, if the contract includes return transport, to return the customer. Any additional costs incurred for the return transport shall be borne equally by the parties. Otherwise, however, the additional costs shall be borne by the customer.
§ 10 Obligations and termination by the customer, warranty, exclusion of claims, statute of limitations
(1) If the trip is not provided in accordance with the contract, the customer may demand remedial action. The tour operator edeltravel Luxusreisen may refuse to provide redress if this would involve disproportionate effort. The tour operator may also provide redress by offering a replacement service of equal or higher value. Any defects that occur must always be reported immediately to the local tour guide or to the address/telephone number below.
(2) If a trip is significantly impaired as a result of a defect and the tour operator fails to remedy the situation within a reasonable period of time, the customer may terminate the travel contract in accordance with the statutory provisions, whereby a written declaration is recommended.
(3) edeltravel Luxury Travel informs the customer of their obligation to report any defects immediately and that, before terminating the travel contract (§ 651 e BGB), a reasonable period of time must be set for remedial action to be taken, unless such action is impossible or is refused by the tour operator, or if immediate termination is justified by a special interest. The customer owes the tour operator the portion of the travel price attributable to the services used, provided that these services were of interest to them.
(4) In the event of non-contractual performance of the trip (defect), the customer may demand compensation without prejudice to a reduction in the travel price (abatement) or termination, unless the defect is due to circumstances for which the tour operator is not responsible.
(5) Warranty claims under the travel contract must be asserted against the tour operator at the address of edeltravel Luxusreisen given below within one month of the contractually agreed end of the trip. After this one-month period has expired, the customer can only assert claims if they were prevented from meeting the deadline through no fault of their own or if the claims are based on tort. Claims by the customer against edeltravel Luxusreisen pursuant to Sections 651 c – 651 f of the German Civil Code (BGB) expire after two years. The limitation period begins on the day on which the trip should have ended according to the contract. If negotiations are pending between the customer and the tour operator regarding the claim or the circumstances giving rise to the claim, the limitation period is suspended until the customer or the tour operator refuses to continue the negotiations.
§ 11 Obligation to cooperate
In the event of service disruptions, the customer is obliged to cooperate in accordance with the statutory provisions on the duty to mitigate damages in order to avoid any damages or keep them to a minimum. In particular, the customer is obliged to immediately report any complaints to the local tour guide/hotel management. If the customer culpably fails to report a defect, there shall be no entitlement to a reduction in price.
§ 12 Liability of the tour operator and limitation of liability
(1) The contractual liability of the tour operator edeltravel Luxusreisen for damages that are not physical injuries is limited to the travel price per trip and customer.
a) insofar as damage to the customer is not caused intentionally or through gross negligence, or
b) insofar as the tour operator is solely responsible for damage incurred by a customer due to the fault of a service provider.
(2) For all tortious claims for damages against the tour operator that are not based on intent or gross negligence, the tour operator shall be liable for property damage up to €4,100; if the tour price exceeds this amount, the tour operator's liability for property damage shall be limited to the amount of the tour price per trip and customer.
(3) The above limitations of liability against the tour operator are limited or excluded to the extent that, on the basis of international agreements or legal provisions based on such agreements that apply to the services to be provided by the service provider, a claim for damages against the service provider can only be asserted under certain conditions or restrictions or is excluded under certain conditions, the tour operator may invoke this against the customer.
§ 13 Passport, visa, and health regulations
(1) edeltravel Luxury Travel informs the customer about passport, visa, and health regulations, as well as any changes to these regulations, before the start of the trip. This assumes that the customer is a citizen of the Federal Republic of Germany. Other circumstances relating to the customer cannot be taken into account unless they have been expressly communicated to edeltravel Luxury Travel.
(2) The customer is responsible for complying with all regulations and provisions that are important for the execution of the trip. Any disadvantages arising from non-compliance with these regulations shall be borne by the customer, unless the tour operator has failed to fulfill its duty to provide information through its own fault.
(3) The customer is responsible for informing themselves about customs and foreign exchange regulations.
§ 14 Price adjustments
(1) edeltravel Luxury Travel reserves the right to change the price agreed in the travel contract in the event of an increase in transportation costs or charges for certain services, such as port or airport taxes, or a change in the exchange rates applicable to the trip in question. If transportation costs, in particular fuel costs, increase, the travel price may be increased in accordance with the following calculation:
a) In the case of a seat-related increase, edeltravel Luxusreisen may charge the customer the amount of the increase. In other cases, the increased transportation costs charged will be divided by the number of seats in the agreed means of transportation. The customer may be required to pay the resulting increase for the individual seat.
b) If taxes such as port or airport taxes are increased for edeltravel luxury trips, the trip price may be increased by the corresponding proportionate amount.
c) In the event of a change in exchange rates, the price of the trip may be increased to the extent that the trip has become more expensive for edeltravel Luxusreisen as a result.
(2) However, an increase in the travel price is only permissible if there are more than 4 months between the conclusion of the contract and the agreed travel date and the circumstances leading to the increase did not occur before the conclusion of the contract and were not foreseeable for edeltravel Luxusreisen at the time of conclusion of the contract.
(3) In the event of a subsequent change to the travel price or a subsequent change to an essential travel service, edeltravel Luxusreisen must inform the customer immediately. Any price increase requested from the 20th day before the agreed travel date is invalid. In the event of price increases of more than 5% or in the event of a significant change to an essential travel service, the customer is entitled to withdraw from the travel contract at no cost or to request participation in another trip of at least equal value if edeltravel Luxusreisen is able to offer such a trip from its own range of trips at no extra cost to the customer.
§ 15 Data protection
(1) The customer is aware and agrees that the personal data required for the execution of the contractual relationship will be stored by the tour operator on data carriers and, if necessary, passed on to affiliated companies within the scope of order processing. The customer expressly consents to the collection, processing, and use of their personal data.
(2) The stored personal data will of course be treated confidentially by the customer. For the purpose of credit checks, the tour operator reserves the right to exchange data with credit agencies.
(3) The collection, processing, and use of personal data shall be carried out in compliance with the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG).
(4) The customer has the right to revoke their consent at any time with effect for the future. In this case, the tour operator is obliged to immediately delete the buyer's personal data. In the case of ongoing usage relationships, the deletion shall take place after termination of the contract.
§ 16 Applicable law, partial invalidity, place of jurisdiction
(1) German law applies exclusively to the travel contract.
(2) The invalidity of individual provisions shall not result in the invalidity of the entire travel contract.
(3) The tour operator edeltravel Luxusreisen may be sued at its registered office. The tour operator may sue the customer at the customer's place of residence.
